Weissman and Regina M. Weissman, husband and wife, as community property with right of survivorship, the real property situated in the City of Foster City, San Mateo County, State of California [note: this applies only in California], commonly known as 927 Laguna Circle, more particularly described as follows on Exhibit A attached hereto and made a part hereof.  [note: Exhibit A is the legal description from the Deed by which you acquired title.]

This is a filled-in sample of the California Community Property with Right of Survivorship Deed for a married couple to convert their previously owned property.  The bold text shows how the form should be filled in.   [Italics notes are hints to assist you.]

It cannot be done until July, 2001.

 

A PCOR (Preliminary Change of Ownership Report) must accompany the Deed to the local Recorder's Office.  Check Box A to report that this Deed is a spousal transfer, exempt from property tax re-assessment as an exempt transfer under Proposition 13.

 

If I cannot record the Deed in person, I can mail it made payable to the County Recorder with a blank check marked "NOT TO EXCEED $25."  Also bring / mail an extra copy of the Deed; they will stamp the copy and give it back to you / mail it with your SASE.  Mailing addresses for many counties' Recorder's Offices.

 

You can get the PCOR on line (although it says Sacramento County, it may be used anywhere in California), OR send a SASE to 927 Laguna Circle, Foster City, CA 94404.  Better yet: get it free from your local County Tax Assessor's office.  Fill in the top Section, check Box A (husband wife transfer) and skip to the bottom of page 2 to sign and date.

 

A Living Trust is a better tool than the Community Property with Right of Survivorship.
